Box 8090 <br /> Stockton, CA 95208 <br /> NOTICE OF VIOLATION <br /> SOIL AND GROUND WATER ASSESSMENT REPORT AND CLOSURE PLAN REVIEW FOR <br /> RE-MANUFACTURING, Ltd. , STOCKTON, SAN JOAQUIN COUNTY <br /> On 14 December 1990, the Regional Board received two reports entitled "Soil and <br /> Ground Water Assessment Report" and "Surface Impoundment Closure Plan" . The <br /> reports were prepared by Kleinfelder, Inc. and submitted on behalf of you and <br /> Re-Manufacturing, Ltd. , in order to satisfy two requirements of Administrative <br /> Civil Liability Order No. 90-236 (Order) . The Order required submission of a <br /> Hydrogeological Assessment Report (HAR) and a closure plan by 15 December 1990. <br /> The Order also requires you to implement an approved closure plan by 1 June 1991. <br /> Staff have reviewed your reports and find the HAR is incomplete and the closure <br /> plan is unacceptable. To bring your facility into compliance with the <br /> requirements of the Toxic Pits Cleanup Act (TPCA) and the Order, all items in <br /> Section 25208.8 of the Health and Safety Code must be completed, and an <br /> acceptable closure plan which complies with the requirements of California Code <br /> of Regulations, Title 23, Division 3, Chapter 15 must be submitted and approved. <br /> The deficiencies noted by staff in the enclosed memorandums are provided for your <br /> guidance. Staff recommendations to complete the HAR include, but are not limited <br /> to, the following: <br /> 1 . Determine aquifer characteristics per section 25208.8(f) (3) of the Health and <br /> Safety Code. <br /> 2. Sample a series of borings to determine the extent of soil contamination in <br /> or adjacent to the surface impoundment. Define the lateral extent of the <br /> potential pollutant migration per Section 25208.8. <br /> 3. Re-sample wells quarterly and determine the ground water gradient monthly, <br /> for twelve consecutive months. <br /> In addition, an approvable closure plan addressing the enclosed staff comments <br /> must be submitted and the closure implemented by 1 June 1991. If the HAR is not <br /> completed, the closure plan is not approvable and closure is not implemented by <br /> 1 June 1991, the balance of the original civil liability in the amount of $99,500 <br /> will be due and payable to the Cleanup and Abatement Account, with interest, as <br />
