Failed to maintain spill control equipment. A yellow pallet used for storing waste lead acid batteries, <br />located outside of the service department enclosed within the fence yard with new tires, is storing dark <br />oily substance. Spill pallets must be maintained dry and empty in preparation for emergency use. Spill <br />pallets are not a storage container for holding liquids unless it is storing liquid from an unintentional <br />release. All facility communications/ alarm systems, fire protection equipment, and decontamination <br />equipment, where required, shall be tested and maintained as necessary to assure its proper operation <br />in time of emergency. Immediately have the dark oily substance be removed from the spill pallet and <br />explain how the waste was managed. <br />403. Failed to store hazardous waste in a compatible container. Red dark saturated absorbent pads <br />were found stored on top of the drained used oil filter drum's lid. There are no properly labeled <br />containers to store the waste absorbent. Hazardous waste must be stored in a compatible container to <br />ensure there is no leakage or release of waste. Container material should not react with the waste. <br />Immediately correct by providing a properly labeled hazardous waste container for any waste absorbent <br />pads. <br />603. Failed to mark initial date of accumulation on satellite container. An approximately 20 gallon drum <br />nearly full of brake fines is missing its start accumulation date. All hazardous waste containers shall be <br />marked with the following information: <br />1. the words "Hazardous Waste", 2. name and address of generator, 3. hazardous properties <br />4. physical state, 5. composition (contents), 6. satellite accumulation start date 7. date when it <br />became full <br />Immediately label these containers and ensure that all containers are marked with all the required <br />information. Since it appears the last pick up of brake metal fines was from 06/2011, immediately <br />contact a licensed hazardous waste hauler to dispose of this waste under manifest and submit a copy of <br />the manifest to the EHD. <br />Submit to SJC EHD within 30 days (08/20/12): <br />1. one copy of the completed "Return to Compliance Certification" form <br />2. a written corrective action statement for the above violations <br />3. requested/ supporting documents. ie. disposal receipt <br />Notes: Last employee haz waste training 4/2012 <br />- in 2011 year, facility generate approximately 14955 gallons of used oil (59.82 tons), 875 gallons of <br />used antifreeze (3.5 tons) and 0.15 tons of brake metal fines = 63.47 tons of hazardous waste. <br />ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE. <br />THIS FACILITY IS SUBJECT TO REINSPECTION AT ANY TIME AT EHD'S CURRENT HOURLY RATE. <br />EHD Inspector: <br />Thuy Tran (209) 468-8257 <br />Titl . <br />EHD 23-02-003 Rev 04/19/12 CONTINUATION FORM <br />
