The following is an itemized list of hazardous waste violations that have not been <br />addressed for TRACY TOYOTA as of October26, 2018. <br />Open violations from August 28, 2018 inspection <br />Violation #114 - Failed to keep signed copy of manifests from the designated facility for three years. <br />Manifest numbers: <br />-014054411JJK (4/28/16) <br />-014054412JJK (4/28/16) <br />-017791774JJK (8/24/17) <br />-017791835JJK (8/30/17) <br />were found without a signed off copy from the destination facility. Hazardous waste generators shall retain copies of <br />all manifests signed off by the destination facility on site for three years and have them readily available for review. <br />If the generator did not receive a copy of the manifest with the handwritten signature of the owner or operator of the <br />facility to which the generator's waste was submitted within 35 days of the date the waste was accepted by the initial <br />transporter, the generator shall contact the transporter and/or the owner or operator of the designated facility to <br />determine the status of the waste. If the generator did not receive a copy of the signed off copy of the manifest <br />within 45 days of the date that the waste was accepted by the initial transporter, the generator shall submit an <br />Exception Report that includes a legible copy of the missing manifest, and a cover letter signed by the generator <br />explaining the efforts to locate the hazardous waste and the results of those efforts. Exception reports shall be <br />submitted to: <br />DTSC Report Repository <br />Generator Information Services Section <br />P.O. Box 806 <br />Sacramento, CA 95812-0806 <br />Immediately locate a copy of the missing manifests or prepare and submit an exception report to DTSC. Submit to <br />the EHD a copy of the signed off copy of the manifests or a copy of the exception report submitted to DTSC. <br />Violation #301 - Facility not maintained to minimize the release of a hazardous waste. <br />-Two metal filters were observed on the ground next to a blue metal 55 gallon drum of oily solids on the south side <br />of the shop. <br />-The brake lathe machine collection basin was full of brake lathe shavings and brake lathe shavings were observed <br />on the floor around the machine. <br />Facilities shall be maintained and operated to minimize the possibility of a fire, explosion, or release of hazardous <br />waste to air, soil, or surface water which could threaten human health or the environment Immediately clean up the <br />metal filters and brake lathe shavings and manage according to Title 22 hazardous waste regulations. Submit a <br />statement and supporting documentation explaining how this waste was managed. <br />Page 1 of 2 <br />
