ROBERT R.VIEIRA AND CLEO R.VIEIRA <br /> 26106 South Patterson Pass Road <br /> Page 2 of 2 <br /> requests for access to your 26106 site to complete the investigation and characterization of the <br /> fuel release as required by EHD directives. <br /> Stratus, the consultant for the responsible parry for the leaking UST site, has stated in writing <br /> that if you grant the access request, BP will handle all costs associated with this investigation. If <br /> contamination from the ARCO/BP leaking UST system is detected on your property, BP will be <br /> responsible for the continued investigation and cleanup, as directed by EHD. <br /> Under California Code of Regulations Title 23, Chapter 16, Article 11, Section 2720, a <br /> "Responsible Party" is any owner of property where an unauthorized release of a hazardous <br /> substance from an underground storage tank has occurred. Property owners of adjacent parcels <br /> who fail to grant UST responsible parties access for required investigative purposes will be <br /> required to conduct an investigation at their own expense. Off-site authority to investigate is <br /> provided in Health and Safety Code Section 25289 '7n order to carry out the purposes of this <br /> chapter, any duly authorized representative of the local agency or the board has the authority[to <br /> investigate, inspect, monitor, and obtain soil and ground water samples]..., with respect to any <br /> place where underground storage tanks are located, and...with respect to real property which is <br /> within 2,000 feet of any place where underground storage tanks are located."If you do not allow <br /> BP access to your property, EHD will place your site in the Local Oversight Program and will <br /> direct you to investigate the extent of contamination on your property. EHD strongly <br /> recommends you promptly provide access to BP for Stratus to install the borings and wells as <br /> directed by EHD and allow access for sampling on a 'quarterly' schedule. <br /> You may contact Nuel Henderson at (209) 468-3436 should you have any questions.
