` 303 South Cherokee Lane TL A91701.01 <br /> 1 March 10, 1995 Page 7 <br /> L <br /> L 5.0 REPORT <br /> Twining will prepare a technical report documenting field procedures and presenting <br /> L findings, evaluations, and conclusions. A site location map, site plan showing soil boring <br /> locations, final boring logs, and subsurface cross-sections (if appropriate) will be included. <br /> L6.0 SITE SAFETY <br /> L It is anticipated that Twining personnel will conduct the proposed work in Level D or <br /> modified level C protection. The site safety plan is presented in Appendix B. <br /> L7.0 LIMITATIONS <br /> LThe proposed work is intended to be an interactive process. Additional work to more fully <br /> assess the extent of PPCs in soil is not anticipated but could become necessary. <br /> LThe purpose of a geologic/hydrogeologic study is to reasonably characterize existing site <br /> conditions based on the geology/hydrogeology of the area. In performing such a study, it <br /> is understood that a balance must be struck between a reasonable inquiry into the site <br /> Lconditions and an exhaustive analysis of each conceivable environmental characteristic. <br /> No investigation is thorough enough to describe all geologic/hydrogeologic conditions of <br /> Linterest at a given site. If conditions art not identified during the study, such a finding <br /> should not be construed as a guarantee of the absence of such conditions at the site, but <br /> L rather as the result of the services performed within the scope, limitations, and cost of the <br /> work performed. <br /> L There are no third-party beneficiaries of this agreement between the client and Twining and <br /> no third-party shall be entitled to rely upon any work performed or report prepared by <br /> Twining hereunder for any purpose whatsoever. The client shall indemnify and hold <br /> L Twining harmless against any liability to any third-party for any loss, expense, or damage <br /> arising in connection with reliance by any such third-party on any work performed or reports <br /> issued by Twining. <br /> LTwrining's professional services will be performed, findings obtained, and conclusions <br /> prepared consistent with generally-accepted environmental assessment principles and <br /> L practices in San Joaquin County at the time the work is performed. This warranty is in lieu <br /> of all other warranties, either express or implied. <br /> L <br /> L <br />
