The facility's business plan was not submitted electronically to the California Environmental Reporting System (CERS). As of January 1, 2013, all businesses were required to submit all business plans electronically. Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. This is a repeat violation, Class II. 3 HSC 25507 Failed to establish and implement a hazardous materials business plan. A Hazardous Materials Business Plan has not been established or implemented. A Hazardous Materials Business Plan shall be established and implemented for emergency response to a release or threatened release of a hazardous material when storing hazardous materials at or above the thresholds quantities of 55 gallons for materials that are liquids, 500 pounds for solids, or 200 cubic feet for compressed gas, at standard temperature and pressure. Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, enter the required information, and submit for review by the EHD. This is a repeat violation, Class ll. 4 CCR 2652(a)(1) Failed to complete and/or submit the Business Activities or Owner/Operator Identification page. The Business Owner/Operator Identification form has not been submitted. This information must be current and submitted as part of the business plan. Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. This is a repeat violation, Class ll. 5 HSC 25505(a)(1) Failed to complete and/or submit hazardous materials inventory for all reportable materials on site. Nine 8 gallon propane cylinders, one > 1,200 gallon and one > 159 gallon tanks of diesel (actual size off the tanks was not known/available), two 55 gallon drums of waste oil, one 55 gallon drum of antifreeze, and one 282 cubic oxygen cubic foot cylinder, and one 265 gallon tote of diesel exhaust fluid were found on site that have not been reported. Any material that meets or exceeds the reportable quantity shall be reported in the facility's business plan. Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, add the materials to the hazardous material inventory, and submit to the EHD for approval.
