The following is an itemized list of aboveground petroleum storage act violations that <br /> have not been addressed for MARTINI-BROWER CO as of June 13, 2019. <br /> Open violations from April 30, 2019 inspection <br /> Violation#301 -Failed to amend Plan as necessary. <br /> Three generators, each with 1,026 gallon belly tanks storing diesel were observed at the facility and are not address <br /> in the SPCC plan. Per facility personnel, the generator belly tanks may have been storing the diesel for over six <br /> months.The two 10,000 gallon diesel tanks appear to be permanently manifolded and this is not addressed in the <br /> SPCC plan. The Spill Prevention, Control, and Countermeasure (SPCC) Plan must be amended when there is a <br /> change in the facility design, construction, operation, or maintenance that materially affects its potential for a <br /> discharge, within 6 months of the change, and implemented as soon as possible, not later than 6 months following <br /> preparation of the amendment. The SPCC Plan should accurately represent the procedures and policies currently in <br /> place at the facility. <br /> Note: Permanently manifolded tanks are tanks that are designed, installed, or operated in such a manner that the <br /> multiple containers function as a single storage unit(67 FR 47122, July 17, 2002).Accordingly, the total capacity of <br /> manifolded containers is the design capacity standard for the sized secondary containment provisions(plus freeboar <br /> in certain cases). <br /> Violation#706-Failed to provide and maintain adequate secondary containment. <br /> The two 500 gallon new oil single walled tanks were observed with insufficient secondary containment. The SPCC <br /> plan describes the two tanks as being within a low curbed area and secondary containment calculations describe the <br /> bermed area as being able to contain 500 gallons. The two 500 gallon new oil tanks were not observed within a curb <br /> or bermed area. The two 500 gallon tanks did not appear to have secondary containment. Construct all bulk storage <br /> tank installations (except mobile refuelers and other non-transportation-related tank trucks)so that you provide a <br /> secondary means of containment for the entire capacity of the largest single container and sufficient freeboard to <br /> contain precipitation. You must ensure that diked areas are sufficiently impervious to contain discharged oil Dikes, <br /> containment curbs, and pits are commonly employed for this purpose. You may also use an alternative system <br /> consisting of a drainage trench enclosure that must be arranged so that any discharge will terminate and be safely <br /> confined in a facility catchment basin or holding pond..
