CLEANUP AND ABATEMENT ORDER NO. 91- 722 -5- <br /> FOR DELTA TRUCK SALES <br /> STOCKTON, SAN JOAQUIN COUNTY <br /> 25. Issuance of this Order is exempt from the provisions of the California <br /> Environmental Quality Act (Public Resources Code, Section 21000, et seq.) <br /> in accordance with Section 15321(a) (2) Title 14, CCR. <br /> 26. Any person affected adversely by this action of the Board may petition the <br /> State Water Resources Control Board (State Board) to review this action. <br /> The petition must be received by the State Board within 30 days of the <br /> date on which this Order was adopted. Copies of the law and regulations <br /> applicable to filing petitions will be provided on request. <br /> IS HEREBY ORDERED that, pursuant to Sections 13267 and 13304 of the California <br /> Water Code and Section 25208 et seq. of the California Health and Safety Code, <br /> Delta Truck Sales Inc. , shall : <br /> 1 . Submit the remaining information necessary to complete the HAR according <br /> to Section 25208.8 of the Health and Safety Code by 1 September 1991. <br /> 2. Submit a remediation and disposal plan for the stockpiled waste and for <br /> the contaminated soils within the sidewalls of the surface impoundment by <br /> 1 September 1991. <br /> 3. Submit a closure plan by 1 September 1991. If clean closure in not <br /> possible then submit a Report of Waste Discharge by 1 September 1991 for <br /> wastes left in place that describes how the surface impoundment will come <br /> into compliance with the requirements of the California Code of <br /> Regulations, Title 23, Division 3, Chapter 15. <br /> 4. Remove all soils with hazardous levels of waste from the soils surrounding <br /> the surface impoundment and landfilled area, and properly dispose of such <br /> wastes by 1 September 1992. <br /> W � (. <br /> WILLIAM H.
