Box 8068 <br /> Stockton, CA 95208 <br /> Attention: Mary Raygoza <br /> PROPOSED CLEANUP AND P_EATEMENT ORDER, DELTA 1CRUCK SALESp SAN <br /> JOAQUIN COUNTY <br /> As we discussed on 23 March 1990 during a staff inspection, we are <br /> preparing a Cleanup and Abatement Order (C&A) for your facility. <br /> The 3 January 1989 Notice of Violation (NOV) signed by our <br /> Executive Officer required corrective actions for compliance with <br /> the Toxic Pits Cleanup Act (TPCA) . Staff notes that in response . <br /> to the NOV the surface impoundment has been partially excavated and <br /> that approximately 5, 000 yards of waste soil have been stockpiled <br /> on site awaiting proper sampling, waste characterization, <br /> remediation and/or disposal. The environmental assessment of <br /> subsoils and ground water beneath the toxic pit, the ceasing the <br /> discharge (storage) of hazardous waste, and the closure of the pit <br /> are items still out of compliance with the TPCA and have not been <br /> addressed since our January 1989 NOV. <br /> Also no substantial progress toward completion of a Hydrogeological O <br /> Assessment Report (HAR) , Section 25208 .8 Health and Safety Code, <br /> has been accomplished. The proposed C&A will contain a time <br /> schedule with specific tasks and dates for completion of the TPCA v <br /> requirements. A projected HAR completion date of 1 September 1990 <br /> was discussed and tentatively agreed upon. To help you and your <br /> consultant through the closure process and the completion of the <br /> HAR, we are amenable* to breaking down the process into smaller <br /> tasks or phases. Initially, we feel that a reasonable <br /> environmental assessment would include the installation of ground <br /> water wells and a subsoil investigation of potential contamination. <br /> The first phase (Phase 1) towards the completion of the HAR shall <br /> consist of, but is not limited to 1) the characterization of the <br /> remaining waste within the surface impoundment, 2) the insta:lation <br /> of ground water monitoring wells to determine water quality and <br /> gradient, and 3) sampling beneath the surface impoundment to <br /> characterize the lateral and vertical extent of potential migration <br /> of waste residues from the surface impoundment though the vadose <br /> zone and into shallow ground -water.
