Mr. Jack Haines -2- October 14, 1987 <br /> DHS will now proceed with having a notice published in a local <br /> Tracy newspaper, and a notice aired over a local radio station, <br /> requesting public comments on the draft Closure Plan. At the <br /> end of the 30-day comment period, DHS will decide if a Public <br /> Hearing is required to insure that the public has ample <br /> opportunity to participate in the Closure Plan approval process. <br /> DHS will make the determination on whether to hold a Public <br /> Hearing in the Tracy area at, or before, the end of the public <br /> comment period. DHS will consider all comments received during <br /> the public review period as part of the DHS final review of the <br /> draft Closure P'.an. Because of these possible comments, DHS can <br /> in no way guarantee that the draft Closure Plan will be approved <br /> as submitted. <br /> Upbn-:completion `of _the closure activities described in the <br /> Closure "Plan, DDTC and an independent qualified professional <br /> engineer, registered in California must submit a narrative report <br /> that certifies that the unit was closed in accordance with the <br /> approved Closure Plan specification. This certification of <br /> closure is required by both CAC Title 22 Section 67215 and 40 CFR <br /> Part 264 . DHS will review the certification report and will then <br /> either accept or reject the closure effort. DHS approval of the <br /> closure certification will release DDTC from further obligation <br /> to manage the above referenced tanks as hazardous waste units per <br /> State and Federal Regulations. <br /> I have enclosed a copy of the radio and newspaper Public Notices, <br /> including a Fact Sheet describing the Closure Plan.
