The purpose <br /> of their review was to determine if you are in compliance with corrective action orders and <br /> directives. Compliance with corrective action orders and directives is a requirement for <br /> reimbursement of cleanup costs from the Cleanup Fund. <br /> As a result of their review, it has been determined that you are currently not in compliance <br /> because you have failed to respond to corrective action orders issued in two letters dated July <br /> 7, 1994 and September 1, 1994. These letters requested a work plan for the installation of <br /> additional monitoring wells to define the lateral extent of the plume, a work plan for additional <br /> over excavation of the pit, and compliance with the quarterly reporting requirements of section <br /> 2652(d), Title 23, Chapter 16 of the California Code of Regulations (CCR). <br /> For cases such as yours, the Cleanup Fund provides responsible parties with an opportunity to <br /> come into compliance, provided PHS/EHD issues a revised corrective action directive. You must <br /> take positive concrete steps to show compliance with CCR Article 11, the Corrective Action <br /> Regulations, in order to maintain your Cleanup Fund eligibility. <br /> PHS/EHD requires you to comply with the following corrective action directive. Submit a <br /> quarterly report to this office within 30 days of the date of this letter which will summarize all <br /> current activities and present a proposal for the next phase of investigation or remediation as <br /> required by CCR Section 2652(d). A work plan for the next phase of work shall be submitted <br /> this office within 60 days of the date of this letter. The work described in the work plan shall <br /> be completed within 90 days of the date of this letter. <br /> Failure to comply with the corrective action directive described in this letter may jeapordize your <br /> Cleanup Fund eligibility. <br /> A Division of San Joaquin County Health Care Services <br />
