I have in the last 1 1/2 years taken steps on or end as a company <br /> and have created the position of Operations and Safety Coordinator and hired Donnie Kyes <br /> to assume that role and have sent him to numerous HazMat training classes. It was not my <br /> intention to disregard the previous violations but I have taken over 2 other facilities in <br /> Modesto and Napa and have been stretched a little thin. Moving forward I am confident in <br /> Donnie and the processes we have put in place as a company to ensure we will not have any <br /> compliance issues. I will briefly go through each violation and explain how we have <br /> hopefully become compliant once again. <br /> Item #101 - EPA ID#, I was unaware that our EPA ID was deactivated, this was apparently <br /> done from me not signing a form? I did complete the application and questioner that is <br /> sent out each year but failed to submit another form. I did call and had our EPA ID <br /> application and number reinstated. (see attached) <br /> Item# 103 - Emergency Coordinator - The list you provided has been filled out and <br /> communicated to employees of its location next to the phone in our mechanic shop and what <br /> to do should there be a spill or accident. (See Attached) <br /> Item #109/110 -Manifest -From our last inspection 2 years ago we really made a strong <br /> effort to ensure bins were labeled and were being disposed of correctly, however, <br /> EverGreen changed companies to SafetyKleen and apparently there was an issue on their end <br /> in getting us the manifest back. I do send in the manifest to the state once received and <br /> have not been receiving the manifest back signed from the San Jose facility where they end <br /> up. I contacted SafetyKleen and did get copies of the manifest you inquired about. There <br /> are (2) manifest from 2012 and 2013 that I am in the process of getting copies from but am <br /> waiting on SafetyKleens archive dept to get the copies back to me. I have spoken to <br /> Cliford Bible and should have something back by the end of the week. I attached the <br /> copies of the (2) I was able to get from this year. (see Attached) <br /> Item #116/605 - Haz Waste labeling and employee training - This is another area that we <br /> take personally but have room to improve. I have sent both Martin Gonzales (Mechanic) and <br /> Donnie Kyes (Ops & Safety Coordinator) to training classes to improve our processes and to <br /> help better understand them. I did take pictures of the correct labels on drums and hope <br /> it satisfies the requirement. (see Attached) <br /> Once again, my apologies for letting it get to this point.
