DEC 17 <br /> 12 December 2002ENVIRpNMENT HEALTH <br /> PERMMSERVICES <br /> Mr. Steven Osborn <br /> Kinder Morgan Energy Partners <br /> 100 Cement Hill Road, Suite 500 <br /> Fairfield, CA 94533 <br /> REVIEW OF SEMIANNUAL MONITORING REPORT, KINDER MORGAN ENERGY <br /> PARTNERS, L.P., STOCKTON TERMINAL, SAN JOAQUIN COUNTY <br /> We have reviewed the 30 October 2002 Semiannual Groundwater Monitoring Report 2nd and 3rd <br /> Quarter 2002 (Report) submitted by LFR Levine Fricke on behalf of Kinder Morgan Energy Partners <br /> (KMEP) for the former bulk fuel terminal at 2947 Navy Drive in Stockton. The Report summarizes <br /> the results of monitoring activities conducted in July. <br /> We have the following comments on the Report: <br /> 1. Board staff's 8 August 2002 letter requested a statistical review of the groundwater monitoring <br /> data based on the micropurge sampling technique. The Report did not include this review. <br /> 2. Board staff is concerned that the extent of pollution on the site is not defined, and KMEP is <br /> considering monitored natural attenuation(MNA) for a remedial alternative. Board staff will <br /> not consider NINA as a viable remedial alternative until the full extent of pollution is defined, <br /> the concentrations are stable, and there are analytical data to support MNA. <br /> According to Monitoring and Reporting Program No. 5-01-821, the Annual Report is due <br /> 30 January 2003, not in March as proposed in the Report. The Annual Report must include an <br /> evaluation of the groundwater monitoring results obtained using micropurge sampling techniques and <br /> include recommendations for delineation.
