The pilot study detailed in the Bioremediation Work Plan needs a readily implemented <br /> contingency plan if pollution migrates to N-18 and N-19. Thus,we agreed that monitoring <br /> wells N-18 and N-19 will be monitored quarterly and KMEP will leave the GWTS on-site. <br /> The Bakker tank at the GWTS and the engines that power the SVE may be returned to the <br /> lessor. If pollutants are detected in N-18 or N-19, KMEP will notify Regional Board staff <br /> and resample the wells to confirm the presence of the pollutants. KMEP will then restart <br /> the GWTS and submit an incident report that includes recommendations for further action. <br /> In the event that KMEP needs to restart the GWTS, a Bakker tank will be returned to the <br /> site and this can occur in just a few days. In addition, we agreed that Regional Board staff <br /> could ask KMEP to initiate the contingency plan based on the semi-annual electronic <br /> sample results. <br /> 4. KMEP holds a permit to discharge treated groundwater using NPDES Order No. 5-00-217, <br /> which expires on 1 October 2005. This Order requires that KMEP submit a Report of <br /> Waste Discharge for permit renewal by 4 April 2005. We agreed that a portion of the pilot <br /> study should be completed and an evaluation report submitted prior to April 2005. Thus, <br /> KMEP agreed to collect quarterly bioremediation data for one year from February 2004 <br /> until February 2005 and submit a pilot study interim evaluation report. That report will <br /> include tables and graphs such as those already submitted to evidence the occurrence of <br /> bioremediation and may include a request to rescind Order 5-00-217. The pilot study <br /> interim evaluation report is due to Regional Board staff by 1 April 2005, and we will meet <br /> on or about 7 April 2005 to discuss the contents of the report. <br /> KMEP should proceed to implement the work plans with the modifications detailed above. By <br /> 1 August 2004, please submit a final phytoremediation cleanup plan for the source area and by <br /> 1 April 2005, submit an interim evaluation report for the bioremediation pilot study.
