- - ..�.,.�.. ,.u�.un, • AJ U U 1 <br /> CONTAWNATl1ON CLEANUP.LEASE <br /> AND AMENDMENT TO RIGHT OF ENTRY AGREEMENT <br /> This Agreement is made and erntered this-��day of October 1999 by azd betweeli <br /> Lower Jones Company as Lessor and SPPP,L.P., a Delaware linvited partnership, as Lessee, <br /> Recitals <br /> The parties hereto entered that Right of Entry Agreemont dated 1~obruary 7, 1997,affecting <br /> certain real property in San Joaquin County, California, imovm as Lot s of Tract 2394, Tenente <br /> Ranch,according to the Official Map thereof filed for record October 11,1996,in Book ofMaps and <br /> Plats,Vol. 32,page 105. Said Lot S includes 40 acres more or less and bears Assessor's Parcel No. <br /> 131-040-08. <br /> SFPP,L.P. desires to obtain rights to a greater portion of said Lot 3 togothcr with the right <br /> to fence the same and locate connecting pipelines and other facilities above ground. <br /> Agreement <br /> Lessor and Lessee agree to expand said Right of Entry Agreeanent so as to constitute a lease <br /> of the entire Lot S. <br /> The term of this lease s11a11 be five (5) years commencing October 31, 1999, and ending <br /> November 1,2004. Lessee shall have the nght to terminate this lease at the end of any lease year <br /> by giving written notice to Lessor of its election to terminate on or before AliSgst 1st of the lease <br /> year in which the termination is to take place. <br /> Rent shall be$15,000.00 per year payable in adva.uce on or before November 1st of each <br /> year. Rent for the first year shall be paid upon execution hereof. The rent payable hereunder shall <br /> be in addition to any compensatiota paid for said Right of Entry Agreement. <br /> Lessee shall have the right to use the leased premises for the purpose of testing soil and water <br /> and operating acid maintaining monitoring wells, vapor extraction wells and otbQr facilities as <br /> convenient or necessary to clean up contaminated soil and water, Lessee shall fence the portion of <br /> the leased premises actually occupied by its facilities. <br /> Lessor shall have the right to fai'Lz1 Or have others farm the portion of the property not fenced <br /> by Lessee and shall reasonably control noxious weeds on the portion of the leased premises outside <br /> the fenced area of Lessee, ,Lessee shall be responsible to reasonably control noxious weeds within <br /> the fenced area. <br /> Lessor shall have the right to withdraw from the leased premises an area of up to six(6)acres <br /> for an asparagus processing shed wid appurtenances.
