These contracts are exempt from approval by the <br /> Department of General Services if the situation requires prompt action to <br /> protect human health or the environment (Section 25299.36 of Chapter 6.75). <br /> PROJECT ASSESSMENT <br /> The LIA or Regional Water Board shall submit quarterly progress reports to the <br /> DCWP Chief documenting the progress of the project and the use of the funds. <br /> The progress reports are due by the 15th of the month following the quarterly <br /> reporting period. The DCWP Chief may request ad hoc reports at any time. If <br /> by IDCWhe StateeWatereBoards thetDCWPdChief may stopre not 9furtherused odisbursementoses secified <br /> The Regional Water Board or LIA shall notify the Contract Manager, upon project <br /> completion and submit a final report describing the work accomplished. The <br /> final written report must be submitted at least two weeks prior to the Contract <br /> termination date. The DCWP will review the report to verify that costs <br /> incurred were necessary and reasonable and that the agency or contractor <br /> performed the required work. The DCWP may conduct a final inspection of any <br /> cleanup project. Final payment will not be made until the final report has <br /> been received and approved by the Contract Manager. <br /> COST RECOVERY <br /> Whenever costs have been incurred from the EAR Account, the DCWP will seek <br /> appropriate cost recovery which may include referring cases to the Attorney <br /> General ' s Office in accordance with Section 25299.53(d) and Section 25299.70 of <br /> CE Chapter 6.75. <br /> The Regional Water Board or LIA will be responsible for maintaining accounting <br /> and recordkeeping systems to adequately document all EAR Account expenditures , <br /> all corrective action activities, and all enforcement costs, including any , <br /> disputes with the responsible party, to support cost recovery efforts. <br /> Enforcement costs include all expenditures reasonably related to inducing a <br /> recalcitrant responsible party to comply with a corrective action order and to <br /> recover UST Cleanup Fund expenditures.
