It is, however, after-the-fact. We have visited the site <br /> and have observed that the city of Tracy has already moved the contaminated <br /> material on the site. It would have been more proper to have been able to <br /> comment before your implementation of the project. <br /> Our concerns remain the same as in our previous letters to you. We feel that <br /> the California Regional Water Control Board and the Department of Health <br /> Services, in their letters to you, have adequately addressed our concerns. <br /> We disagree with the finding of no significant impact. If contaminates are <br /> released from the treatment basins, they could contaminate the ground water and <br /> the water within the Delta-Mendota Canal (Canal) which is located adjacent to <br /> the treatment site. In addition, the treatment basins have been constructed on <br /> land which the Bureau of Reclamation (Bureau) has an easement. If the land <br /> should become contaminated, the Bureau would not be able exercise its rights <br /> provided by the easement for use of the land for operation of the Canal. <br /> In consideration of the potential impacts, we requests that the waste material <br /> be relocated to an appropriate site. <br /> If you have any questions, please contact Herbert S.Y.
