Paul Verma, Project Manager
City of Tracy
520 South Tracy Boulevard
Tracy CA 95376
Subject: City of Tracy -- Initial Study - Negative Declaration Waste Discharge,
Schulte Road Project -- Delta-Mendota Canal Easement -- Milepost 14.80
to 15.01 Right -- Central Valley Project (CVP) CA (Land Management
Policy)
Dear Mr. Verma:
Thank you for the opportunity to comment on your Initial Study for the above
reference project. It is, however, after-the-fact. We have visited the site
and have observed that the city of Tracy has already moved the contaminated
material on the site. It would have been more proper to have been able to
comment before your implementation of the project.
Our concerns remain the same as in our previous letters to you. We feel that
the California Regional Water Control Board and the Department of Health
Services, in their letters to you, have adequately addressed our concerns.
We disagree with the finding of no significant impact. If contaminates are
released from the treatment basins, they could contaminate the ground water and
the water within the Delta-Mendota Canal (Canal) which is located adjacent to
the treatment site. In addition, the treatment basins have been constructed on
land which the Bureau of Reclamation (Bureau) has an easement. If the land
should become contaminated, the Bureau would not be able exercise its rights
provided by the easement for use of the land for operation of the Canal.
In consideration of the potential impacts, we requests that the waste material
be relocated to an appropriate site.
If you have any questions, please contact Herbert S.Y. Ng of my staff at (209)
836-6248.
Sincerely,

Walter D. Jourda
^Project Superintendent -
