Although no permit has been issued for this operation, the <br /> City has begun excavation of the contaminated soils from the Schulte Road <br /> project, transported the soils to the airport, and placed them into treatment <br /> cells. Our understanding was that the soils would be temporarily stored at the <br /> airport at the City of Tracy's risk until waste discharge requirements were <br /> obtained. Now, we understand that the treatments cells have been constructed <br /> without our approval and the wastes placed in these units. <br /> The City of Tracy Department of Public Works has determined that it will act as <br /> the lead agency for purposes of compliance with the California Environmental <br /> Quality Act (CEQA) . The City has issued a Notice of Preparation (NOP) for an <br /> Environmental Impact Report. As lead agency the City is responsible for <br /> circulation of the NOP to interested parties. <br /> An environmental checklist was received with the NOP. This checklist indicates <br /> that the project could not have a significant effect on the environment. We <br /> disagree with this conclusion. We also note that the checklist was not signed. <br /> We will not proceed further with our efforts to expedite waste discharge <br /> requirements for this site unless the City properly circulates the NOP. <br /> Without satisfactory progress towards completion of the CEQA requirements and <br /> other agency permitting requirements, the Regional Board may be required to issue <br /> a Cleanup and Abatement Order requesting removal of these wastes to an <br /> appropriate site. <br /> If you have any questions, please contact Robert Evans at (916) 361-5737. <br /> WILLIAR J.
