Your presence and <br /> contributions allowed for a better understanding of your involvement in the required upcoming investigation of <br /> the leaking underground tanks (UGT). <br /> As owners and operators of the UGTs, you and your partner John Parker, are to be designated as the primary <br /> responsible parry for the investigation and remediation from the operations of the previous installed UGTs. <br /> Previous owners/operators of the UGTs can be listed as additional responsible parties if it can be determined that <br /> they actually operated the tanks. <br /> Your admitted limited use of the UGTs in 1982-1983 and the noted severely deteriorated condition of the UGTs <br /> at the time of removal in 1985 suggest that any unauthorized release from the tanks has been ongoing <br /> substantially prior to 1982 to 1985. PHS-EHD is prepared to include John and Mary Gabian as additional <br /> responsible parties unless you can offer verification that they did not operate the UGTs during their ownership of <br /> the property. <br /> As discussed at the hearing, a workplan to continue your investigation should be submitted to PHS-EHD no later <br /> than May 24, 1996. <br /> Please feel free to contact PHS-EHD if you need help completing your Clean Up Fund application or if you have <br /> any questions concerning the Corrective Action Regulations.
