Qualls, General Counsel, requested <br /> an FMD for reconsideration of the Fund Staff Decision dated February 14, 2007, for <br /> eligibility to the Fund. Fund Staff denied your claim because the documentation <br /> necessary to determine your eligibility for access to the Fund was not submitted. <br /> Decision <br /> Following my review of your letter, and the additional supporting documents submitted <br /> on June 15, 2007, 1 have decided to find in your favor and overturn the Staff Decision. <br /> Your claim is'accepted for placement on the Priority List in Priority Class "C"with a <br /> deductible of$5,000. <br /> Background and Discussion <br /> According to the San Joaquin County Environmental Health Department, there are two <br /> separate releases and occurrences for this site. The first release and occurrence was <br /> reported on September 21, 1991, for which a claim was submitted to the Fund (Claim <br /> No. 5320). Palisades Gas and Wash, Inc. acquired this site in November 1997, and a <br /> second release and occurrence was reported on July 30, 2002. Any costs associated <br /> with the first release and.occurrence reported September 21, 1991, are ineligible for this <br /> claim. Since this site involves two separate occurrences, you are entitled to a maximum <br /> reimbursement of$1.5 million of eligible corrective action costs, less the deductible of <br /> $5,000. <br /> Compliance Review <br /> This completes the initial review.
