WASTE DISCHARGE REQUIREMENTS -11- <br /> LIBBEY-OWENS-FORD COMPANY <br /> LATHROP PLANT NO. 10 <br /> SAN JOAQUIN COUNTY <br /> c) The Discharger shall submit the results from the biotoxicity <br /> monitoring program to the Board in accordance with the program <br /> schedule. <br /> If the discharge produces in-stream toxicity, the Discharger shall <br /> conduct an investigation and develop a corrective action plan. <br /> 5. The Discharger shall comply with the attached "Standard Provisions <br /> and Reporting Requirements (NPDES)" dated 1 October 1990, which are <br /> a part of this Order. <br /> 6. The Discharger shall notify the Board not later than 180 days in <br /> advance of implementation of any plans to alter production design <br /> capacity of the product line of the manufacturing, producing or <br /> processing facility by more than ten percent. Such notification <br /> shall include estimates of proposed production rate, the type of <br /> process, and projected effects on effluent quality. Notification <br /> shall include submittal of a new Report of Waste Discharge. <br /> 7. The Discharger shall comply with the attached Monitoring and <br /> Reporting Program No. 91-056, as ordered by the Executive Officer. <br /> 8. This Order expires on 1 February 1996 and the Discharger must file <br /> a Report of Waste Discharge in accordance with Title 23, California <br /> Code of Regulations, not later than 180 days in advance of such date <br /> as application for issuance of new waste discharge requirements. <br /> 9. In the event of any change in control or ownership of land or waste <br /> discharge facilities presently owned or controlled by the <br /> Discharger, the Discharger shall notify the succeeding owner or <br /> operator of the existence of this Order by letter, a copy of which <br /> shall be forwarded to this office. <br /> 10. The Board will review this Order periodically and may revise <br /> requirements when necessary. <br /> I , WILLIAM H.
