To <br /> request a waiver, complete the enclosed "Permit Waiver Request" form and return with any <br /> additional information requested below. The double deductible is applicable regardless of the <br /> reason or reasons that the permit was not obtained or applied for between January 1, 1984 and <br /> January 1, 1990. UST owners and operators have an obligation to be aware of the laws that <br /> apply to their business. Permit compliance ought not be excused because the claimant was not <br /> specifically notified of the permit requirement by appropriate governmental agencies. Senate <br /> Bill 1061 addressed the problem and allows the claimants into the Fund who were unaware of <br /> the permit requirement but who took reasonable actions upon becoming aware. To distinguish <br /> between the UST owner that complied with the law and the owner that did not, the double <br /> deductible was a part of the compromise. <br /> You are required to demonstrate financial responsibility. Enclosed are forms and instructions. <br /> Questions regarding financial responsibility should be directed to Lily Fung at (916) 341-5676. <br /> There has been a change in Priority Class B criteria. Complete and return the enclosed <br /> Addendum to Cleanup Fund Claim Application Request for Assignment of Claim to Priority <br /> Class B (Small Business). Include the required documentation supporting the number of <br /> employees. <br /> You have applied as the claimant with Mr. Henry Niemann as the joint claimant. The joint <br /> claimant must meet the same eligibility requirements as the claimant. An eligible claimant: <br /> 1)must be a former or current owner or operator of the leaking tank, 2)must be a responsible <br /> party directed to cleanup by the regulatory agency, and 3)must have incurred and paid the <br /> corrective action costs.
