I, <br /> 1 3. Mr. and Mrs. Ruiz purchased the grocery store from <br /> 2 DECEDENT on May 10, 1986. Three months later, routine testing <br /> 3 of the two existing underground storage tanks indicated a , <br /> 4 product loss in one of the tanks . The underground storage <br /> 5 tanks contained leaded and unleaded gasoline and were on the <br /> 6 property on May , 10, 1986, when Mr. and Mrs . Ruiz took <br /> 7 possession. <br /> 8 1,i 4 . In June 1988, one monitoring well was installed and <br /> 9 sampled. The laboratory results evidence benzene, toluene, <br /> 10 ethylbenzene and xylene in the soil and groundwater. Three <br /> 11 monitoring wells continue to be tested for these and other <br /> 12 contaminants on a quarterly basis'. Said monitoring is required <br /> 13 by San Joaquin County Public Health Services Environmental <br /> id <br /> 14 Health Division which .is the lead regulatory agency. <br /> 15 5 . Wilibaldo and Stella Ruiz seek a claim of <br /> 16 reimbursement, indemnity, or contribution against the estate of <br /> 17 DECEDENT for any loss,, damage, cost, claim or other expense, <br /> 18 they may incur or suffer by reason of the allegations in the <br /> 19 pending matter. <br /> 20 6 .
