Ms . Mary Meays <br /> San Joaquin County <br /> Public Health Service <br /> October 28 , 1992 <br /> Page 3 <br /> must realize, the Ruizes can only proceed to the extent <br /> that funds permit. Proceeding immediately with a full PAR <br /> would have one of three results: ( 1 ) a consultant would not <br /> proceed without proof of ability to pay (which the Ruizes <br /> could not do) ; (2 ) the PAR would be prepared and the Ruizes <br /> would make payment over an extended period time--no work <br /> would be undertaken until full payment was made, and further <br /> contamination could result in the interim; or ( 3 ) the <br /> Ruizes are forced to file bankruptcy if consultants sue for <br /> payment. for the County initi6ted enforcement action. None of <br /> these are acceptable alternatives. The Ruizes are aware of <br /> their obligation, and desire to proceed in a manner which is <br /> financially feasible. <br /> We are aware that proceeding with soil remediation prior <br /> to characterizing the horizontal and vertical extent of <br /> contamination is not preferred; however, the property owner <br /> is financially limited, and we believe this is the most <br /> propitious action for the environment. To change the focus <br /> of the work to be completed will require additional bidding, <br /> which is time consuming and labor intensive for prospective <br /> consultants . I fear that some, if not all, consultants may <br /> lose .intere.st if this project is put out for bid for the <br /> third time. if we cannot obtain bids, then no work will be <br /> completed, which would .be a far worse result. <br /> Therefore, we recommend proceeding with the development <br /> and production of a remedial action plan focusing on interim <br /> soil remediation. Said plan will be submitted to the County <br /> by December 21, 1992 , for approval. We seek your <br /> confirmation of this course of action.
