CALIFORNIA REGIONAL WATER QUALITY CONAL BOARD <br /> CENTRAL VALLEY REGION <br /> MONITORING AND REPORTING ORDER No. R5-2009-0833 <br /> CALIFORNIA WATER CODE SECTION 13267 <br /> FOR <br /> H & H MARINA PROPERTIES LLC <br /> H & H MARINA <br /> 15135 EIGHT MILE ROAD <br /> STOCKTON, SAN JOAQUIN COUNTY <br /> This Order is issued to H & H Marina Properties LLC (hereafter Discharger) pursuant to <br /> California Water Code section 13267, which authorizes the Executive Officer of the <br /> California Regional Water Quality Control Board, Central Valley Region (hereafter <br /> Central Valley Water Board) to issue a Monitoring and Reporting Order (Order). <br /> The Executive Officer finds: <br /> INTRODUCTION <br /> 1. The Site is located at 15135 Eight Mile Road in Stockton near the Little Connection <br /> Slough and bounded to the east and north by agricultural fields, Eight Mile Road to <br /> the south, and a levee to the west. H&H Marina Properties LLC owns the real <br /> property and leases it to Bustez Enterprises, which owns and operates the marina. <br /> 2. The Site has two aboveground storage tanks (AGTs), associated above- and below- <br /> ground piping, and 13 monitoring wells. <br /> 3. Investigations have shown that elevated levels of petroleum hydrocarbon <br /> compounds are present in groundwater at the Site, which flows generally to the <br /> south and varies from about two to six feet below ground surface. This pollution <br /> impaired the beneficial use of this water resource. <br /> 4. In 2004, the Discharger started cleaning up groundwater using an extraction and <br /> treatment system. In 2007, contaminated soil from a new spill was excavated, <br /> removed, and properly disposed of at an offsite facility. <br /> 5. This Monitoring and Reporting Program (MRP) is issued pursuant to Section 13267 <br /> of the California Water Code and is necessary to delineate groundwater pollutant <br /> plumes and determine whether remediation efforts are effective. <br /> 6. Existing data and information about the Site show the presence of various <br /> chemicals, including total petroleum hydrocarbons (TPH) as gasoline, benzene, <br /> toluene, ethylbenzene, xylenes, methyl tertiary butyl ether (MTBE), tertiary butyl <br /> alcohol (TBA), and tertiary amyl methyl ether (TAME) emanating from the property <br /> under the control of the Discharger. <br /> 7. The Discharger shall not implement any changes to this MRP unless and until a <br /> revised MRP is issued by the Executive Officer. This MRP replaces the <br />
