Ms. Cantu has forwarded your letter to me for
response. In your letter, you state that the above claim was removed from the Fund in Fall 2001
and that the case should be classified as a UST site.
After review of the Fund file for this case, the April 11, 2003, investigation report prepared by
Advanced GeoEnvironmental, Inc., and discussions with staff at the Regional Water Quality
Control Board, Central Valley Region, I am able to respond as follows:
• There has been no prior decision to terminate or reduce funding for the above claim. To
date, $100,711 has been reimbursed under Claim No. 8531, with the most recent payment
being made in Spring 2001, prior to when the question regarding possible sources of the
MTBE arose.
• At this time we are reviewing available information regarding the possible sources of the
petroleum pollution at the site, and have tentatively concluded that most of the MTBE did
not originate from the USTs. If this is our final determination, future funding would be
significantly reduced.
• We would prefer to have more information prior to making a determination on future
funding of this claim, and understand that a work plan for an investigation is being
prepared. We will await the results of this investigation prior to making a funding
decision.
• Any decision made by the Fund may be appealed in accordance with Fund regulations.
California Environmental Protection Agency
a Aecycled Paper
