The Report discusses the groundwater monitoring activities
conducted in December.
According to Monitoring and Reporting Program (MRP)No. 5-01-835, an annual report was due
by 1 February 2003 and should have included an evaluation of trends and the progress of remedial
activities. The Report does not include a discussion of 2002 activities or trends, groundwater
contour and pollutant concentration maps for each quarter of 2002, or a discussion of remedial
activities. MRPs are information requirements under California Water Code Section 13267, are
enforceable, and can result in administrative civil liability(ACL) of up to $1,000 per day if
adequate information is not received in a timely manner. The information required for an annual
groundwater monitoring report is now more than 25 days overdue and Herman and Helen's
Marina must submit it forthwith. If we receive the overdue report by 28 March 2003,we will not
recommend an ACL.
If you have any questions, you may contact Devra Lewis at(916) 255-3119 or
lewisdna,rb5 s.swrcb.ca.gov.
WEND L.
