Mr. Gregory Torlai, Jr. -4 - • 24 May 2010
H&H Marina
Applicability (NOA) and accommodate the 30-day public comment period required by Order
No. R5-2008-0149. Central Valley Water Board staff concurred with this monitoring
proposal during the meeting. In addition, the idle treatment system must be disconnected
from EW-1 to facilitate groundwater sampling at this well, as required by No. R5-2009-
0833. If H&H again fails to conduct monitoring in accordance with MRP, and as outlined
above, staff will recommend enforcement through an Administrative Civil Liability (ACL).
5. Order No. R5-2008-0149 requires dischargers to provide an MRP detailing the monitoring
and reporting schedule pertinent to the remedial activity being conducted. Thus, H&H's
NOI needs to include proposed monitoring, and either MRP No. R5-2009-0833 will be
modified or a separate MRP will be prepared to monitor the pilot study. Once we receive
the results of the bench-scale test and all the information required in the NOI, Central
Valley Water Board staff will prepare the draft NOA and MRP and provide the draft
documents for your review and comment. After we receive your comments, we will conduct
the 30-day public comment period.
By 10 June 2010, please submit the ORC Work Plan Addendum, including the procedures for
the bench-scale test.
If you have any questions regarding this letter, you may contact me at (916) 464-4811 or at
betaylor@waterboards.c ov.
BRIAN E.
