CLEANUP AND ABATEMENT ORDER009-XXXX -g' <br /> BUSTEZ ENTERPRISES,INC.AND H& ARINA PROPERTIES,LLC <br /> H&H MARINA,15135 EIGHT MILE ROAD, STOCKTON, SAN JOAQUIN COUNTY <br /> 2. All work shall be conducted under permits required by State, County, and/or Local <br /> agencies. <br /> 3. The Dischargers are required to submit, under penalty of perjury under the laws of the <br /> State of California, the following technical reports and implement the following actions by <br /> the dates listed below. <br /> F <br /> plete Notice of Intent 5 February 2010 <br /> I to enroll in NPDES General Order No. R5-2008- <br /> r Monitoring Reports 5 February 2010 <br /> st due quarterly monitoring reports required by MRP <br /> 0828 (second quarter 2009) and MRP No. R5-2009- <br /> 0833 (third and fourth quarters 2009). Submit the past due second <br /> quarter 2009 NPDES Monitoring Report. <br /> Implement Approved Remedial Actions 26 February 2010 <br /> Conduct the proposed and approved remedial actions in <br /> accordance with the 13 February 2009 Additional Site Assessment <br /> Report. <br /> Resume operation of the groundwater treatment system 26 February 2010 <br /> Operate and report on the remediation system according to the <br /> requirements of NPDES General Order No. R5-2008-0085. <br /> GROUNDWATER MONITORING <br /> 5. Conduct monitoring of the existing wells and any additional wells in accordance with <br /> Monitoring and Reporting Program (MRP) No. R5-2009-0833 or any revised MRP issued <br /> by the Executive Officer. <br /> GENERAL REQUIREMENTS <br /> The General Requirements are included in Attachment A of this Order. <br /> If the Dischargers are unable to perform any activity or submit any document in compliance <br /> with the schedule set forth herein, or in compliance with any work schedule submitted <br /> pursuant to this Order, the Dischargers may request, in writing, an extension of the time <br /> specified. The extension request shall include justification for the delay. Any extension <br /> request shall be submitted as soon as the situation is recognized and no later than the <br /> compliance date. An extension may be granted by revision of this Order or by a letter from <br /> the Executive Officer. Extension requests not approved in writing by the Executive Officer <br /> with reference to this Order are denied. <br /> If, in the opinion of the Executive Officer, the Dischargers fail to comply with the provisions of <br /> this Order, the Executive Officer may refer this matter to the Attorney General for judicial <br /> enforcement or may issue a complaint for administrative civil liability.
