Mr. Brian Walker - 2 - 10 August 1999 '.
Based on these results,the release from the former underground storage tank at the site can now be
considered to be a low threat to water quality and qualifies for an NFA status. However, newly enacted
legislation(AB 681 -Machado,which modified Section 25297.1 and 25297.15 of Chapter 6.7 of the
Health and Safety Code,effective-1'January 1999)requires that all responsible parties notify all current
record owners of fee title to the site of any corrective action or site closure proposals submitted to the lead
agency(Regional Board). Furthermore,the responsible parties must certify to the Regional Board, in
writing, that the notification requirement has been met, and include a complete mailing list of all record
owners of fee title. The written certification must include proof that the owners of record have been sent
notice (certified mail receipts or other proof mechanisms).
P
Before we can issue an NFA letter, we also need proof that all MWs at the site have been destroyed in
accordance with California Well Standards, California Department of Water Resources Bulletin 74-90 and
other requirements that the San Joaquin County Public Health Services may,require. During a telephone
- conversation with staff on 5 August 1999, Mr. Santochi stated that Mr. Mike Infuma of the San Joaquin
County-Public'Health Services`requested`that at-least=one of your MWs,be retained:for-monitoring a site — - — --;
upgradient of your property. Therefore, we also need a certification of transfer of liability and
responsibility, including future proper destruction, for MWs which may be needed by adjacent sites.
If you have any questions, you may call meat (916) 255-3081 or e-mail at isorenp@rb5s.swrcb.ca.gov.
PHELIP ISO NA
Associate Engineer
_cc: Mr. Mike Infurna, San Joaquin Public Health Services, Stockton K
Y&N Avalon Environmental Consultants,Newport Beach
Ms. Teri Copeland, Irvine
a 1.
S
1 `y
{
