Jennifer Frase [EH]
From: Robert McClellon [EH]
Sent: Tuesday, December 30, 2008 4:20 PM
To: 'Motmans, Bill'
Cc: Strough, Barbara; Lee, Jim; Michael Kith [EH]; Jennifer Frase [EH]
Subject: RE: Updates
Mr. B's Enterprises
Mr. Bywater passed away in early October 2008. The property was in Mr. Bywater's name and his ex-wife's
name, Mary Jane Bragato. From what I understand she had been trying to remove her name due to the legal
issues Mr. Bywater was dealing with. After he passed away, Mary Jane and her Brother, Angelo Bragato, filed for
possession of the property. At that time I sent Tire Program information to Mary Jane in San Mateo after
discussing Waste Tire manifesting issues with Angelo.
As of early November, Mr. Bragato phoned and told me that a contractor had been hired to clean up the property.
The plan was to consolidate the tires at one corner of the property and then hire a registered hauler to remove
them. The difficulty at that time was the crowded conditions on site due to multiple trailers and trash, which he
would need to remove first before he could get back to the tires. Eviction notices had also been issued to the
illegal tenants living in trailers on the site. I discussed the manifesting issues with the tires and hazardous waste
issues on the site. Angelo insisted that he understood proper procedures as he used to be a contractor. Title for
the property was to be clear in late November. Mr. Bragato informed me that he would be out of town until the
beginning of December and he would call as soon as work began. He seemed sincere. We will follow up with Mr.
Bragato and confirm a start date for the removal.
1882 E. Eight St.
The remaining tires at 1882 E. Eight St were taken to Golden By-Product. The contractor and the listing agent did
not respond to us. I got the confirmation from Golden By-Product(GBP), the contractor hauled 10 loads of 9 tires
at a time to GBP and GBP hauled one load at 452 tires for them.
6293 S. Kaiser Rd
Half of the tires have been hauled away by Jorge Padilla. The other half have been determined to be
on the neighboring parcel. We are currently work with the neighbor to remove the tires. He has stated that he
would have them removed shortly. There are less than 500 tires onsite.
Please let me know if there is any additional information you need. Thanks Robert
Robert McClellon, Program Coordinator REHS
Environmental Health Department
600 E. Main Street
Stockton, CA 95202
(209)468-0332
From: Motmans, Bill [mailto:bmotmans@CIWMB.ca.gov]
Sent: Tuesday, December 23, 2008 1:51 PM
To: Robert McClellon [EH]
Cc: Strough, Barbara; Lee, Jim
12/31/2008
