An inspection report was issued identifying information to be
submitted to bring this site into compliance. This information was required to be submitted by 2-26-11. A Return to
Compliance Follow Up Letter dated 3-28-11 was sent to you. This information has not been received resulting in a
non-compliant status for this facility.
Note: the sensor out/power out (fail safe) tests to verify positive shutdown of the turbines could not be verified
during the 1-26-11 annual monitoring system certification testing. Per the technician, equipment failure that
occurred during the inspection prevented the diesel turbine from turning on. Immediately have a licensed certified
contractor trouble shoot and repair the equipment. A permit may be required depending upon he scope of work.
Immediately schedule an inspection to verify sensor out/ power out (fail safe) tests to verify positive shutdown of
turbines or schedule for tank line tests to be performed. Please be aware that a re -inspection will be charged at our
current hourly rate. The 1-26-11 annual monitoring system certification is still considered incomplete.
Failure to correct the violations will result in continuing/additional violations.
Note: All EHD staff time associated with failing to comply, including the issuance of this letter, is billed at the
current hourly rate ($122). Failure to submit the completed information immediately may result in a re-
inspection or further legal action.
The missing information includes:
r Current UST Facility form (former Form A)
r Test results from the Annual Monitoring
Certification of positive turbine shutdown for
fail safe and power out or annual line test
P Response plans
w Certification of Financial Responsibility and
Letter from Chief Financial Officer
r Certification of Return to Compliance (Signed
and dated)
P— Current UST Tank form (former Form B)
r Annual monitoring certification, leak detector
and spill bucket test results
P/ Designated Operator monthly reports
I— Permit submitted to repair or replace failed
equipment
r Statement of how each violation was or will
be corrected
Most forms may be accessed from our web site address, http://www.sjgov.org/ehd/Programs/UnitlII/hazwaste.html.
If you have any questions, please call Aris Cacapit, REHS at (209) 468-3453.
S''e
xr-156-
Aris Cacapit, REHS
Registered Environmental Health Specialist
