In determining whether a violation is <br /> chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the <br /> violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including <br /> corrective action). <br /> On October 17,2016,Fatinah Zareef of the San Joaquin County Environmental Health Department(EHD)performed a routine underground storage <br /> tank inspection at the above referenced site.An inspection report was issued identifying information to be submitted to bring this site into compliance. <br /> This information was required to be submitted 30 days after receiving the inspection report.This information has not been received resulting in a non- <br /> compliant status for this facility. <br /> The outstanding violations include but are not limited to the following: <br /> -A permit to operate the UST system has not been issued due to non-compliance. No person may own or operate an underground storage tank unless <br /> a permit for its operation has been issued by the local agency to the owner or operator of the tank(HSC 25284). <br /> -The current financial responsibility and other required documents have not been submitted into the California Environmental Reporting System(CERS) <br /> website,current financial responsibility documents are required to be submitted annually.
