A violation that impairs the ability of an underground storage tank system to detect a liquid leak or contain a liquid release of petroleum in the manner required by law. p A chronic violation or a violation that is committed by a recalcitrant violator. In determining whether a violation is chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including corrective action). On October 17,2016,Fatinah Zareef of the San Joaquin County Environmental Health Department(EHD)performed a routine underground storage tank inspection at the above referenced site.An inspection report was issued identifying information to be submitted to bring this site into compliance. This information was required to be submitted 30 days after receiving the inspection report.This information has not been received resulting in a non- compliant status for this facility. The outstanding violations include but are not limited to the following: -A permit to operate the UST system has not been issued due to non-compliance. No person may own or operate an underground storage tank unless a permit for its operation has been issued by the local agency to the owner or operator of the tank(HSC 25284). -The current financial responsibility and other required documents have not been submitted into the California Environmental Reporting System(CERS) website,current financial responsibility documents are required to be submitted annually. Immediately log into the CERS at http://cers.calepa.ca.gov/, and upload the required documents(HSC 25292.2). -The 87A line leak detector failed to detect a leak when tested.All line leak detectors shall be capable of detecting a 3-gallon per hour leak at 10 psi. Immediately have a properly licensed,trained,and certified contractor repair or replace the failed leak detector under permit(as required)and inspection from the EHD(CCR 2636(f)(2)). The site must be brought into compliance to avoid your entire UST system being red tagged -7-days from the receipt of this Notice.
