In response, claimant submitted a letter from the City of
Stockton, dated December 31, 2001 (copy enclosed).
Regretfully, that documentation does not satisfy the decommissioned requirement as defined in the
California Code of Regulations (see enclosure for LG-122).
To further determine your eligibility for placement on the Priority List,please complete the enclosed
Permit Waiver Request Form.
Note: A "decommissioned"tank per LG-122 is one that cannot have inputs or withdrawals, for one
or more'of the following reasons: Ifif has been filled rvitl3 an inert solid; 2) ifs fill pip—es ive been
sealed, or 3) its.piping has been removed. A tank that was not used on or after January 1, 1984 but
could be used in the future meets the definition of an existing UST and is subject either to the
operating or closure requirements of the law and regulations.
NOTE: Failure to respond to this request within thirty (30) calendar days from the date of this letter may
result in an ineligibility determination of your claim.
,... : ' ;7fr, t- ri .. r.J t _.- . ._'. .. - ..' .. -s .. ,+-1'+; .a .F: Af-t.. .. sxr -i . .-r.'• J.-
;, r ;.i i` s''. ` ',f a .. .. .;'3r,i6-. n fT"..r 2F;
Cn/i/ornia Enriroanuenta/Protection Aeeucs
a Retycl dP'tper
