McCartney: <br /> At the request of Mr. Min Le , President of McBillin Real Estate Investment, Advanced <br /> GeoEnvironmental , Inc. (AGE) has prepared this letter requesting a suspension of <br /> assessment and remediation work at 2154 South EI Dorado Street, Stockton , California . <br /> McBillin Real Estate Investment purchased the property in June 2010 without knowledge <br /> of the presence of the underground storage tanks (USTs) or any associated environmental <br /> issues . By letter dated 05 August 2010 , San Joaquin County Environmental Health <br /> Department (SJCEHD) issued a "Notice To Abate" requiring the USTs to be either removed <br /> or closed in place. To date , McBillin Real Estate Investments has incurred over $25 , 000 <br /> for the removal of five USTs in October 2010 and now faces financial hardship proceeding <br /> with the SJC-EHD-required subsurface investigation , as directed by letter dated 05 <br /> November 2011 . <br /> McBillin Real Estate Investment has limited assets and has exhausted all possible avenues <br /> of funding . As you are aware, because of the ongoing national banking fiscal crisis, McBillin <br /> is unable to obtain any kind of financing (including private) to proceed with investigation <br /> and/or development of the property. Furthermore, Mr. Le lacks any additional personal <br /> funds to proceed with work at the site . <br /> On 14 February 20111 AGE completed and submitted an application to the Underground <br /> Storage Tank Cleanup Fund ( USTCF) on behalf of McBillin Real Estate Investment. The <br /> USTCF is currently the only possible funding source for the required subsurface <br /> investigation . <br /> As you are aware, the USTCF is currently not issuing new Letters of Commitment for new <br /> claims . If McBillin Real Estate Investment's USTCF application is accepted , it will likely be <br /> several months before funding is made available .
