Waterloo Road (State Route 88), <br /> Assessor Parcel Number 08710011, Stockton, CA 95215 <br /> The San Joaquin County Environmental Health Department (EHD) provides regulatory oversight <br /> of the contamination from unauthorized releases of petroleum from underground storage tanks <br /> (USTs). The investigation of a release from former USTs at 4315 E. Waterloo Road, Stockton, <br /> has been on-going since December1994. <br /> Installation of monitoring wells to investigate groundwater contamination was initiated in 1999. <br /> Groundwater monitoring well MW5 was installed in December 2005 and is east of the USTs and <br /> dispensers about 35 feet from the west property line of your property. Since the installation of <br /> MW5 concentrations of total petroleum hydrocarbons as gasoline (TPH-g), MTBE and 1, 2 DCA <br /> in the water samples from that well have increased. The concentration of MTBE was 300 <br /> micrograms per liter (ug/1) and the concentration of 1, 2 DCA was 260 ug/I in the water sample <br /> collected on March 16, 2009, from MW5. The primary maximum contaminant level for drinking <br /> water for MTBE is 13 ug/I and for 1, 2 DCA is .5 ug/I. The extent of this contaminant plume <br /> must be defined. Based on site data it is suspected that the plume of contaminated <br /> groundwater has migrated beneath your property. <br /> In June 2008 the EHD directed Shell Oil to place a monitoring well east of MW5. Because of , <br /> the short distance to the east property line Shell proposed installing the well on your property <br /> and the EHD approved of this proposal. Shell Oil has informed the EHD that you have not been <br /> willing to grant access to your property for installation of the monitoring well. Access to your <br /> property is necessary to investigate the extent of the groundwater plume contaminated with <br /> TPH-g, MTBE and 1, 2 DCA. 36 <br /> The EHD requests that you negotiate a property access agreement with Shell Oil so the <br /> investigation of the plume of contaminated groundwater can proceed. Work can be performed <br /> during non-business hours to alleviate problems that may occur for your tenant, Taco Bell, <br /> during their business hours. The EHD is willing to meet with you and Shell Oil in an effort to <br /> reach an agreement. <br />
