In determining whether a violation is <br /> chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the <br /> violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including <br /> corrective action). <br /> This facility is in violation of California Health &Safety Code (HSC)sections 25290.1(c)(2)and 25290.1(e). On May 20, <br /> 2013, the following was found at the facility: Leaking and broken penetration fittings in the 91 turbine and fill sumps and <br /> the 87 fill sump. The 91 turbine sump was missing all interstitial fluid. The operator was instructed in writing and by <br /> verbal communication to immediately repair the sumps under an approved repair permit. The San Joaquin County <br /> Environmental Health Department(EHD) has not received a repair permit application. <br /> Submit a repair permit application and initiate repairs immediately after permit approval by the EHD. <br /> Please be aware that failure to comply may result in the EHD affixing Red Tags to the 87 and 91 product fill pipes on the <br /> the UST system in seven (7) business days in accordance with HSC section 25292.3 and California Code of Regulations <br /> (CCR) sections 2717-2717.7.
