Z A violation that impairs the ability of an underground storage tank system to detect a liquid leak or contain a liquid release of petroleum in the manner required by law. ❑ A chronic violation or a violation that is committed by a recalcitrant violator. In determining whether a violation is chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including corrective action). This facility is in violation of California Health &Safety Code (HSC)sections 25290.1(c)(2)and 25290.1(e). On May 20, 2013, the following was found at the facility: Leaking and broken penetration fittings in the 91 turbine and fill sumps and the 87 fill sump. The 91 turbine sump was missing all interstitial fluid. The operator was instructed in writing and by verbal communication to immediately repair the sumps under an approved repair permit. The San Joaquin County Environmental Health Department(EHD) has not received a repair permit application. Submit a repair permit application and initiate repairs immediately after permit approval by the EHD. Please be aware that failure to comply may result in the EHD affixing Red Tags to the 87 and 91 product fill pipes on the the UST system in seven (7) business days in accordance with HSC section 25292.3 and California Code of Regulations (CCR) sections 2717-2717.7. No person may deposit petroleum into an underground storage tank system that has a Red Tag affixed to its fill pipe (CCR section 2717.1(% Please be aware that this and future enforcement action is billable at the current EHD hourly rate.
