EXHIBIT E- UST COMPLIANCE MANAGEMENT PROGRAM <br /> Equilon Enterprises LLC dba Shell Oil Products US ("SOPUS")has developed an <br /> Underground Storage Tank ("UST") Compliance Management Program and shall maintain this <br /> UST Compliance Management Program for all Current Facilities as defined. in Paragraph 5 of the <br /> Final Judgment. <br /> Nothing in this document or any UST Compliance Management Program shall be <br /> interpreted or applied to relieve Defendants of their existing obligations to comply with statutes, <br /> regulations, requirements, or other laws, or with the Final Judgment issued in this matter <br /> The UST Compliance Management Program shall include the following: <br /> (a) eSite and Smart Sensors <br /> eSite, a monitoring system consisting of a network of"smart" or programmable sensors, <br /> shall be used to monitor for fuel leaks and other environmental alanns. The Smart Sensors (the <br /> "sensors") are connected to the monitoring system via the eSite. <br /> (i.) The eSite monitoring system shall be used to. <br /> — monitor and prevent sensor tampering; . <br /> — limit access for the programming and resetting of the sensors and monitoring <br /> systems to authorized personnel; <br /> — allow for real time monitoring of all sensors' status, alarm conditions and data, <br /> — monitor all environmental and maintenance technician activity at the site <br /> related to sensors and eSite programming and maintenance; <br /> — monitor all site-level environmental compliance activity and have the <br /> capability to store permits and related compliance documentation at the site; <br /> — store all sensor alarm activity and history on site; <br /> — allow for remote monitoring of the network with the ability to troubleshoot and <br /> resolve issues remotely where appropriate and allowed by regulation. <br /> (ii.) The Smart Sensor,shall be- <br /> - a programmable sensor that can be used to monitor UST secondary monitoring <br /> systems for fuel or water accumulation, <br /> programmable to provide the flexibility to meet a variety of regulatory and user <br /> requirements, <br /> — tamper-proof when connected to the eSite network and will alarm, shut down <br /> the fuel system and record the event into the alarm history if accessed or moved <br /> by an unauthorized individual. <br /> People v.
