We have not yet exceeded the budget amount due to production levels being a little
higher than anticipated, in spite of the weather we have encountered.
When preparing the budget for the Interim Remedial Action Plan(IRAP) we anticipated removing no
more than 300-tons total of contaminated soil from the areas around MW-9 and MW-3 based upon
geologic cross sections prepared from soil borings drilled and laboratory data collected for both areas.
More contaminated soil that what was anticipated will be encountered as we move southward towards
MW-3 and the back of the former gas station area where the tanks were located. We have observed that
the contaminated soil is presenting a deeper and wider cross section than discovered in the areas soil
borings were placed. This accounts for the increased quantity of contaminated soil.
Continuing with the IRAP and removing the contaminated soil from the area of MW-3 is appropriate
and will accomplish the essence of a directive issued some time ago that essentially required the
responsible party to reduce source concentrations when free product was discovered in MW-3 and MW-
9. However, Wright will need two things by Tuesday at close of business:
1.) A directive from Mr. Infurna at EHD to continue the IRAP work and therefore his approval to
extend the approval of the proposed IRAP to include the increased quantity of soil encountered
that differs from what was included in the IRAP.
2.) An authorization(change order)from the responsible party to proceed as we will exceed the
budget and amount authorized by the last work authorization.
Absent an authorization to proceed from the Cox Cox Partnership and a directive from EHD Wright will
then suspend IRAP work, secure the site (backfill and grade) and complete the treatment of what water
is on site and get the Baker Tank removed. By stopping work on Wednesday and shifting focus to
securing the site we may exceed the budget amount forecast when the IRAP work was authorized.
I will be available all day today to answer any questions you may have.
John Lynch
209-833-0758 office
209-603-3394 cell / 'f/ pmayc,
// W1Z:76r .-
3/1/2004
