At this writing, we do not have an opinion <br /> regarding the inquiry. <br /> We have been recently advised,verbally,that the primary agency responsibility overview will <br /> shift from the State Water Resources Control Board to San Joaquin County Environmental <br /> Health Department with associated monitoring costs being allocated by the county. <br /> San Joaquin County's Environmental Health Department has requested the names and <br /> addresses of previously known owners of the referenced property. Accordingly, we will <br /> comply with that directive. <br /> Should you have knowledge of those preceding you in ownership of the property, please <br /> advise me of same. We will forward that data to the appropriate agency. <br /> Please be advised it is our understanding that prevailing State and/or Federal law provides <br /> that the original "generators" of the pollution may be liable for costs of remediation. <br /> Further research is obviously necessary to clarify the issue. <br /> Since it's inception, it has been our objective to minimize the costs of dealing with the <br /> problem. We,jointly,may now be confronted with additional expense to decontaminate the <br /> property as a result of possible State mandates. Those costs may be distributable to former <br /> owners, original waste generators, current owners, or any combination thereof, all in <br /> accordance with interpretation of prevailing law and current case rulings. <br /> We intend to vigorously pursue the Underground Storage Tank Fund for reimbursement of <br /> cleanup costs. If eligible, most major costs of cleanup will be defrayed, subject to a$10,000 <br /> deductible. <br /> I am enclosing for your information our latest data report containing most recent, as well <br /> as accumulated, historical site test contaminant levels. <br /> Please call me if there are questions. <br /> VS' r , <br /> obert .
