DC-94-2 OF RICHARD CASTEEL <br /> The applicant is requesting a Dwelling Cluster for 5 remodeled <br /> units and 5 new units, located on the east side of Anteros <br /> Avenue, 450 feet north of Miner Avenue, in east Stockton. This <br /> project is in the Enterprise Zone. <br /> The Community Development Department has reviewed this item and <br /> offers the following comments: <br /> A public storm drainage system is required pursuant to Section 9- <br /> 836.5(f) of the Development Title. The Department of Public <br /> Works has indicated that a public storm drainage system is not <br /> available for this project. If the applicant wishes to withdraw <br /> this application, a refund of the application fee will be <br /> processed. If the applicant chooses, to proceed with this <br /> application, the project will be denied due to Public Works' <br /> determination that terminal drainage is not available and the <br /> inability to make the following finding:. <br /> (a) The dwelling cluster proposed is consistent with the General <br /> Plan; any applicable Master;Plan, Specific Plan, or Special <br /> Purpose Plan; and any other applicable plan adopted by the <br /> County which affects the property. <br /> This finding cannot be made because a public storm drainage <br /> system is not available. Policy i of the General Plan for <br /> Stormwater Drainage provides that a public drainage system <br /> may be required in Urban Communities for discretionary <br /> applications. Storm Drainage Implementation No. 1 provides <br /> that the Development Title •hail specify required stormwater <br /> drainage facilities. <_section 9-836.5(f) of the Development <br /> Title requires public storm drainage systems for Dwelling <br /> Clusters in urban communities. <br /> CM:ss <br /> c: Richard Casteel <br />
