Recommendations' :. <br /> V <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve Use Permit No. PA-0700046 with the Findings and Conditions of Approval contained in <br /> the staff report. <br /> { Findings <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, <br /> any applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> i <br /> • This finding can be made because the establishment, maintenance, and operation of an <br /> 1 olive processing mill is a conditionally permitted use in the-AG-40 zone with an approved <br /> Use Permit application. There are no Master Plans, Specific Plans, or Special Purpose <br /> Plans in the:vicinity. <br /> 2. Adequate utilities; roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This finding'can be made because projects in the AG-40 zone may use a private septic <br /> system, an individual well, and on-site storm drainage. The olive mill has direct access to <br /> Arata Road,The project would also be able to access Navone Road if there is a recorded <br /> access agreement. All the required roads are existing. The project will be served by a <br /> private septic system, an individual well, and on-site drainage. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This finding can be made because the project parcel is a flat, rectangular 8.3-acre orchard <br /> that has access to a public road and is of adequate size and shape to accommodate the <br /> proposed use and all yards, building coverage, setbacks, parking areas and other <br /> requirements of this Title. <br /> 4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare, or be <br /> injurious to the property or improvements of adjacent properties. <br /> h ' <br /> • This finding,can be made because an Initial Study prepared for this project found no <br /> potentially significant environmental impacts.The conditions of approval that are part of <br /> the Use Permit ensure that issuance of the permit will not be significantly detrimental to <br /> the public health, safety, or welfare, or be injurious to the property or improvements of <br /> adjacent properties. <br /> C—) San Joaquin County".
