Because of the special circumstances <br /> applicable to the property, including size, shape, topography, location, <br /> or surroundings, the strict application of the regulation deprives the <br /> property of privileges enjoyed by other property in the vicinity and <br /> under identical classification: j <br /> The property is in a unique location and surrounded by <br /> multiple parcels that are inconsistent with the zoning of AG-40. <br /> (See attached Exhibits B-1 & B-2). Specifically, out of the 40 <br /> total parcels there are only 3 parcels that are 40 acres or more <br /> and 34 of the 40 parcels are at 20 acres or less. <br /> 2. No Special Privileges. The granting of the Variance will not <br /> constitute a grant of special privileges inconsistent with the limitations <br /> upon other properties in the vicinity and zone in which the property is 1 <br /> situated: <br /> a) Due to it's unique location and surroundings, the property <br /> would enjoy no more than the privileges already enjoyed by <br /> the properties adjacent to, in the vicinity of, and in the same <br /> zone as the property. <br /> b) All but 3 of the 40 parcels are well below the 40 acre <br /> minimum and 34 of the 40 parcels are below 20 acres. <br /> c) The granting of the Variance will not constitute a grant of <br /> special privilege as the use is consistent with the majority of <br /> the other existing uses in the immediate area. <br /> d) The Planning Commission has previously approved a <br /> Variance for a factual situation analogous to ours. (PA- <br /> 1400007) <br />
