Analysis <br /> Background <br /> On August 10, 2009, the Community Development Department approved Site Approval application No. <br /> PA-0900094 for a small winery with a tasting room. (Use Type: Wineries and Wine Cellars- Winery, <br /> Small). No outdoor amplified sound was proposed or permitted with the approval of the winery. The <br /> improvements were constructed, and the winery was established. <br /> On April 18, 2017, the Community Development Department approved Improvement Plan application No. <br /> PA-1700086 to permit Accessory Wine Events for a maximum of 80 people, and Wine Release Events for <br /> a maximum of 300 people, in conformance with Development Title Section 9-1075.9. <br /> No new development is being proposed for this Revisions of Approved Application. Parking was reviewed <br /> with the original application for the winery, and with the Improvement Plan for events. No additional <br /> narking spaces are required with the proposed Revisions of Approved Actions application. <br /> -Noise Study <br /> Outdoor amplified sound may be conditionally permitted with an approved land use application at <br /> Marketing Events, Wine Release Events, and Industry Events for small wineries subject to regulations <br /> contained in Section 9-1075.9(f). The events must also comply with Development Title Section 9-1025.9 <br /> regarding stationary noise standards (50 dB Hourly Equivalent Sound Level daytime, 45 dB Hourly <br /> Equivalent Sound Level nighttime, 70 dB maximum sound daytime, 65 dB- maximum sound nighttime), <br /> and outdoor amplified sound shall be permitted between the hours-of 10:00 a.m. and 9:00 p.m. Pursuant <br /> to Development Title Section 9-1075.9(f)(2), a noise study shall be required prior to permitting outdoor <br /> amplified sound to ensure compliance with the Noise Standards specified in Section 9-1025.9. As a <br /> result, a noise study was completed by J. C. Brennan and Associates dated January 23, 2018. The noise <br /> analysis included conducting a staged concert. J.C. Brennan-and Associates set up a sound system on <br /> the stage area which is oriented in the direction of typical music. In addition, the music was played at an <br /> amplitude that is generally typical of outdoor events. <br /> There are scattered residences along the perimeter of the subject parcel. The nearest residence is <br /> located on an adjacent parcel approximately 490 feet east of the event area, and pursuant to <br /> Development Title Section 9-1025.9(a)(1), a residential use is a noise sensitive land use. The noise study <br /> analyzed the noise level at three (3) noise measurement sites while music was playing, and concluded <br /> the winery can comply with County noise level standards provided that the events terminate prior to 10:00 <br /> p.m. Pursuant to Development Title Section 9-1075.9(f)(1), outdoor amplified sound must terminate by <br /> 9:00 pm, which has been included in the recommended Conditions of Approval. As a result, the noise <br /> impacts from events are anticipated to be less than significant. <br /> Williamson Act <br /> The proposed project site is currently under the California Land Conservation Act and subject to <br /> Williamson Act Contract No. 77-C1-135. The contract restricts development to uses that are compatible <br /> with the Wil!iamson Act and Development Title Section 9-1805. "Compatible use" as defined in the <br /> Williamson Act includes uses determined by the County to be compatible with the agricultural, <br /> recreational, or open-space use of land within the preserve and subject to contract. (Government Code <br /> Section 51201[e]) In addition, Development Title Section 9-1810.3(1)(AA) permits wineries and wine <br /> cellars as a compatible use on contracted land. <br /> San Joaquin County PA-0900094/Bokisch <br /> Community Development Page 5 <br />
