Land uses and structures which contain hazardous materials or wastes which may <br /> be a safety hazard for nearby areas shall be located away from existing and planned populated <br /> areas. <br /> Police 4. The use of hazardous materials and the creation of hazardous wastes shall be <br /> minimized. <br /> Policy 5. All development shall be consistent with the County's Waste Management Plans. <br /> Zoning Classification <br /> The San Joaquin County Zoning Map designates the existing landfill site (including the creek <br /> corridors) and the proposed 2014 Expansion Project areas as AG-40, General Agriculture,40- <br /> acre minimum. Uses permitted in AG zones include agricultural and certain residential, <br /> agricultural commercial, agricultural processing, communication, educational, utility, religious, <br /> recreation, and Major Impact Services uses. In the AG-40 zone, the minimum size for new <br /> parcels is 40.0 acres. The San Joaquin County Development Title specifies that the Major Impact <br /> Services use classification is a permitted use in AG-40 zone, subject to an approved Use Permit <br /> application. Major Impact Services use types include sanitary landfills, which are defined as <br /> ,+ land intensive activities that must be located away from residences or concentrations of people <br /> due to the nature of the operation's impacts. The existing Forward Landfill is classified under <br /> the Major Impact Services use type and currently permitted under San Joaquin County Land <br /> Use Permit No. UP-00-7 granted by the Board of Supervisors in April 2003. <br /> Bird Strikes and Gull Survey Evaluations <br /> The 2013 EIR discussed information on bird strikes available at that time. The following <br /> paragraph updates that discussion with new information available at the time this SEIR was <br /> prepared (Davis, 2013, see Appendix C for a copy of this report). The Federal Aviation <br /> +r- Administration (FAA)began tracking bird/aircraft collisions at the Stockton Airport(SCK) in <br /> 1990. The FAA database documenting bird/aircraft collisions contained records of 45 bird <br /> strikes associated with the Stockton Airport, as of December 31,2013. Of the 45 strike reports <br /> i, from Stockton Airport, one involved a gull(carcass only) and three others might have involved <br /> gulls. Even allowing for significant under-reporting of bird strikes, four strikes at SCK in over <br /> 20 years with no damage reported indicates that the uncontrolled Forward Landfill was not <br /> posing a significant threat to aircraft using the Stockton Metropolitan Airport. Twenty-three of <br /> the reported bird strikes at SCK occurred since the gull control program was instituted at <br /> Forward Landfill. These strikes involved Barn Owls (3), a Burrowing Owl, a White-tailed Kite, <br /> Red-tailed Hawks (3), a Turkey Vulture, an American Kestrel, Horned Larks (3), Western <br /> Meadowlarks(2), a Rock Pigeon, an European Starling,unidentified small birds (4), and two <br /> unidentified birds. No gulls were involved and none of the birds struck were attracted to the <br /> area by the landfill. <br /> L. <br /> The project applicant has implemented a program to survey gull populations in the vicinity of <br /> the landfill and has implemented a permanent gull control program to prevent the potential for <br /> bird strikes and deter gulls from flying, landing or feeding at or near the landfill. Forward <br /> Landfill safety procedures include monitoring bird populations at the site. Bird surveys <br /> (conducted over a period of at least 1.5 hours on a single day) observed 500 gulls on February <br /> 23, 2005, 661 gulls in January 2007, 75 gulls on January 14,2009, and 400 gulls on February 10, <br /> .. 2010 (Schneider, 2005;Stagnaro, 2009). The lower number of gulls observed in 2009 was <br /> attributed to deterrent measures (whistles and bombs) employed by the landfill. <br /> L <br />
