to" Draft Supplemental Environmental Impact Report Page IV.A-20 <br /> Forward Inc.Landfill 2014 Expansion Project <br /> • Site visits in addition to the minimum of six monthly visits described above shall be <br /> made if necessary to verify the criteria for failure described below. <br /> • The results of the monitoring shall be documented in an annual report. <br /> • Landfill staff shall participate in monitoring so that action can be taken as soon as a <br /> potential problem is identified. <br /> The control program shall be considered to be failing and will require upgrading if any of the <br /> following situations occur: <br /> • Gulls land at the active disposal area, begin to feed, and are able to feed for 10 <br /> minutes or more, on two or more occasions during a week. <br /> • Flocks of gulls begin loafing on other parts of the landfill and are not scared away by <br /> the control program within 30 minutes, on more than two occasions during a week. <br /> • Gulls begin to circle over the landfill, including adjacent creek areas, and are not <br /> removed by the falcons. If this behavior continues over a period of one week, then it <br /> indicates that the birds are likely getting food at the landfill. <br /> The above triggers do not specify a minimum number of gulls because if one or two gulls are <br /> present, they will soon attract other gulls and numbers will build up. Therefore,it is essential to <br /> deter the first gulls. <br /> In the event that the bird control measures proposed as part of the project, described above,in <br /> combination with the gull control program described in this mitigation measure, are found to <br /> be ineffective in reducing the numbers of flocking birds by the criteria described above, the <br /> project sponsor shall implement one or more of the following: <br /> 1. The falconry program shall be intensified to ensure that there are no gaps in coverage <br /> and that additional falcons are available for those days when it may be necessary to fly <br /> the falcons often. <br /> 2. The operator shall introduce a more comprehensive pyrotechnic-based control program <br /> to supplement the falconry program. Many landfills successfully control gulls using <br /> only a pyrotechnic-based program. The pyrotechnics program shall provide coverage <br /> when the falcons were not on site during the week and on weekends. The pyrotechnics <br /> program shall also cover areas remote from the active area to remove loafing gulls. <br /> 3. With the exception of removal of prey base for predatory birds and mammals, actions <br /> involving special-status bird species, and actions involving the restored habitat areas of <br /> Littlejohns Creek, the operator shall implement the recommendations for vegetation, <br /> wildlife, and water management contained in Odell, Russel W., Senior Wildlife Biologist, <br /> U.S. Department of Agriculture,Animal and Plant Health Inspection Service, Wildlife Services <br /> California,Letter to John Funderburg, Principal Planner,San Joaquin County <br /> Community Development Department, August 29,2011. <br /> The Conditions of Approval for the proposed project shall include the requirement that the <br /> ton project sponsor,prior to construction, file a Notice of Proposed Construction or Alteration <br /> (Form 7460-1)with the Federal Aviation Administration. <br /> As discussed under Impact A.4,below,implementation of the procedures to discourage and <br /> monitor bird populations and comply with regulatory requirements related to bird hazards that <br /> are proposed as part of the project, along with Mitigation Measure A.1, would reduce bird <br />
