Landfill 2014 Expansion Project <br /> provide undeveloped open space for nature study,protection of endangered species, and <br /> 6. preservation of wildlife habitat. Specific policies of the SJCGP calls for the protection of <br /> significant biological and ecological resources, including wetlands, riparian areas, rare, <br /> threatened, and endangered species and their habitats, potentially rare or commercially <br /> i.. important species, vernal pools, significant oak groves and heritage trees. The SJCGP outlines <br /> implementation measures intended to protect special-status species and their habitats and trees, <br /> to preserve and restore natural habitats for wildlife, to preserved and restore wetlands and <br /> riparian habitat, and to seek ways to acquire natural areas. <br /> San Joaquin County Multi-Species Habitat Conservation and Open Space Plan <br /> San Joaquin County is a signatory to the San Joaquin County Multi-Species Habitat <br /> Conservation and Open Space Plan(SJMSCP;SJCOG 2000). Participation in the SJMSCP, which <br /> is voluntary, satisfies the requirements of federal and State endangered species acts (FESA and <br /> CESA), and ensures that potential impacts are mitigated to a less-than-significant level in <br /> compliance with CEQA. The SJMSCP provides incidental take authorization for 97 listed and <br /> non-listed plant, fish, and wildlife species and provides compensation for habitat losses through <br /> 6. collection of fees that are used to preserve habitats elsewhere. <br /> The project proponent proposes to continue participation in the SJMSCP. By participating, the <br /> L proposed project would be consistent with the Final EIR/EIS for the SJMSCP, dated November <br /> 15,2000, and certified by the San Joaquin Council of Governments on December 7,2000. <br /> Participation in the SJMSCP provides the project proponent with incidental take authorization <br /> for any of 97 covered species, in accordance with ESA Section 10(a)(1)(B) and CESA Section <br /> L 2081(b). Participation in the SJMSCP also provides "measures to offset not only incidental take <br /> pursuant to ESA and CESA,but also provides mitigation to offset cumulative impacts to <br /> common plant, fish and wildlife species and to offset other impacts associated with open space <br /> conversions (e.g.,impacts to agricultural lands, impacts to scenic resources, and similar <br /> impacts) which must be addressed pursuant to CEQA) (Section 1.1.4.1). <br /> Participation in the SJMSCP will reduce impacts to covered species and habitats to a level of <br /> L less-than-significant level. Mitigation fees vary by the type of lands being affected and are based <br /> on the habitat type: <br /> Habitat Type Fees31 <br /> Multi-Purpose Open Space $7,281 per acre <br /> Natural $14,543 per acre <br /> ` Agriculture $14,543 per acre <br /> Vernal Pool-uplands $42,784 per acre <br /> Vernal Pool -wetted $85,631 per acre <br /> However,participation in the SJMSCP does not satisfy the requirements of the USACE, <br /> RWQCB, CDFW pertaining to impacts to surrounding waterways, wetlands, creeks, channels <br /> and streambed alteration;permits for these impacts must be obtained separately. Forward <br /> previously has participated in the SJMSCP under the 2002 consolidation project of the Austin <br /> Landfill and Forward Landfill. Similarly, participation in the SJMSCP does not address <br /> potentially significant impacts to non-covered species.
