Draft Environmental P <br /> Impact Report Page IV.E-3 <br /> Forward Inc. Landfill Expansion Project <br /> waste-related regulations and proposed landfill programs include the RWQCB orders, RWQCB- <br /> required SWAT, NPDES permits,workers right-to-know, Hazardous Materials Management <br /> Plan (HMMP),Storm Water Pollution Prevention Plan(SWPPP), and California Department of <br /> Toxic Substances Control incident reports. The RWQCB is the lead regulatory agency with a <br /> history of overseeing environmental monitoring of the Forward and Austin Road landfills and <br /> is the agency in charge of overseeing the environmental reporting on the combined landfill <br /> when that project is approved. <br /> There are currently two Board Orders stipulating the monitoring and reporting requirements <br /> for the existing Forward Landfill: Waste Discharge Requirements (WDRs) Order No. R5-2003- <br /> 0049, R5-2003-0080 (Monitoring and Reporting Program and Groundwater Treatment System, <br /> NPDES No. CA0082911) and Order R5-2008-0714. Quarterly and annual reports of the <br /> monitoring results are submitted by Forward Inc. to the DTSC, RWQCB, and the San Joaquin <br /> County Public Health Services Department, Environmental Health Division,which is the Local <br /> Enforcement Agency (LEA). The Forward Inc. Landfill also is operating under Waiver of Waste <br /> Discharge Requirements for Composting (RWQCB Resolution 96-031); WDR-City of Stockton, <br /> 2000; Hazardous Waste Generators Permit No. 008450, San Joaquin County Public Health <br /> Services (SJCPHS), 1998; Hazardous Waste Facility Postclosure Permit, Department of Health <br /> Services (DOHS), 1989;and the RCRA Hazardous Waste Facility Postclosure Permit No. <br /> CAL000190080, EPA, 1990. <br /> The RWQCB is currently in the process of reviewing the reports leading up to a revised <br /> Corrective Action Pan per the stipulations of RWQCB Order 2008-0712 for the combined <br /> Forward Landfill to modify its groundwater treatment system to better capture the subsurface <br /> contamination. Other elements of regulatory significance include the landfill gas collection <br /> system, surface water (Littlejohns Creek branches) modification, contaminant plume definition, <br /> and new monitoring wells (to replace existing wells proposed to be closed during the project <br /> implementation). <br /> The proposed landfill expansion requires a Joint Technical Document(JTD) describing <br /> operational and monitoring practices be submitted to the RWQCB and CIWMB for approval. A <br /> draft JTD is in preparation for submission to the RWQCB for their review and approval. The <br /> proposed programs for segregation, special handling, and screening procedures of hazardous <br /> materials are summarized in the Project Description also will be presented in detail in the JTD. <br /> As described in the Project Description,these programs are already in place for the current <br /> Forward Landfill, and would be continued in the proposed expanded landfill. <br /> The San Joaquin County General Plan incorporates public health and safety considerations into <br /> the community's long-term planning. The portions of the General Plan relevant to hazardous <br /> materials are C. Fire Safety and Law Enforcement and E. Hazardous Materials and Wastes, <br /> under V. Public Health and Safety of Volume I: Policies/Implementation. <br /> Baseline and Project-Generated Health Risk Assessment <br /> The applicant prepared a human Health Risk Assessment (HRA) (SCS,2008) that evaluates <br /> Criteria Air Pollutant(CAP) and Hazardous Air Pollutant (HAP) emission levels for the <br /> Forward.Landfill under three scenarios, including two pre-Project or Baseline scenarios as well <br /> as the post-Project scenario. The two Baseline scenarios are: Current Actual (CA) emissions, <br /> determined using 2006 and 2007 operational data; and Current Permitted(CP) emissions,based <br /> on emissions of landfill sources at maximum permitted levels. The Post-Project or Future <br /> Potential (FP) scenario was estimated assuming full implementation of the Project described in <br /> this document,namely the proposed lateral expansion of the Forward Landfill (Forward), creek <br />
