1 Draft Environmental Impact Report Page IV.H-7
Forward Inc. Landfill Expansion Project
1.a having special-status include "special animals", as listed by the CDFG(2008c). "Special
animals" is a general term that refers to all of the taxa the CNDDB is interested in tracking,
regardless of their legal or protection status. This list is also referred to as the list of"species at
1 risk" or"special status species". The CDFG considers the taxa on this list to be those of greatest
conservation need. Additional animal species receive protection under the Bald Eagle
Protection Act and the Migratory Bird Treaty Act (META)'. The State of California created the
classification of "Fully Protected" conserve wildlife species that risk extinction within the State.
Administered by the CDFG, lists of fully protected species were created for fish',mammals6,
birds', and reptiles and amphibians'. Additional information on Fully Protected fish can be
found in the California Code of Regulations (CCR)'. The category of Protected Amphibians and
Reptiles in Title 14 has been repealed. The CCR also provides for the protection of certain
forbearing mammals1D. Additional definitions of endangered, rare or threatened species are
. given in CEQA11.
Based on a review of special-status animal species recorded in the project region(CNDDB 2008),
a total of 55 special-status animal species were evaluated for their potential for occurrence.
1 Based on habitats present in the study area and the context of the project site, four federally
and/or State-listed animal species could potentially occur on site. In additional, 15 non-listed
`. special-status species could occur on site(Table IV.H-1). Below is a discussion of species that
are either potentially occurring in the study area or are prominent in today's regulatory
rl environment.
Several special-status species that occur in the region have some likelihood to occur within the
study area however the majority of the site is agricultural fields and capped landfill. These
habitat types are not considered suitable for most wildlife with the exception of some birds and
insects.
Site visits conducted in 2005 and 2008 are not considered sufficient to confirm presence or
absence of special status wildlife. Therefore, the potential for occurrence on site was assessed
by presence or absence of appropriate habitat and geographic distribution.
I.t
a 16 USC§703-711;50 CFR Subchapter B
s§5515
6§4700
'CFGC§3511
6§5050
'
'CCR,Title 14,Division 1,Subdivision 1,Chapter 2,Article 4, §5.93
70 CCR,Title 14,Division 1,Subdivision 2,Chapter 5,§460
11§15380(d)
