Landfill Expansion Project <br /> t.f <br /> • a conflict with any local policies or ordinances protecting biological resources, such as a tree <br /> preservation policy or ordinance;or <br /> ■ a conflict with the provisions of an adopted Habitat Conservation Plan, Natural Community <br /> Conservation Plan, or other approved local,regional, or state habitat conservation plan. <br /> Impacts and Mitigation Measures <br /> For the purposes of this section, impacts and mitigation measures already required from past <br /> EIRs and project approvals are considered to be part of the proposed project, unless otherwise <br /> P� <br /> s ec <br /> ified. Impacts g acts on and mitigation measure for thesespecies are addressed in the 1999 Austin, <br /> Road EIR, and in the San Joaquin County Multi-Species Habitat Conservation and Open Space <br /> Plan(see below). <br /> Impact H.1.Filling of Waters of the U.S./Waters of the State. As part of the proposed project, <br /> the South Branch of the South Fork of Littlejohn's Creek would be relocated along the eastern <br /> and southern boundary of the proposed expansion area. This would result in the filling of 3000 <br /> i linear feet of creek channel supporting 1.25 acres of wetlands and open water habitat subject to <br />' the jurisdiction of the USACE, CDFG and RWQCB. This is a potentially significant impact. <br /> Mitigation Measure H.1. Prior to site grading the project sponsor shall obtain permits under <br /> i Sections 401 and 404 of the Clean Water Act and Section 1602 of the California Fish and Game <br /> l <br /> Code. These permits, administered by the RWQCB, USACE, and CDFG,respectively, would <br /> identify specific mitigation measures to be imposed on the project as permit conditions. A <br /> Wetland Mitigation and Monitoring Plan shall be prepared and submitted for agency review to <br /> ensure a •"no net loss" of wildlife value or acreage of wetlands or riparian habitat. At a <br /> minimum, the Plan shall include the creation of four(4)acres of new wetlands and nine (9) <br /> Ft acres of riparian plantings associated with the realigned creek channel, as presented in the <br /> conceptual design (Questa Engineering Corporation 2007). The Project Sponsor shall ensure <br /> that all mitigation areas, along with an appropriate upland buffer,be placed in a permanent <br /> conservation easement, or similar deed restriction, and preserved in perpetuity. <br /> Fe The Wetland Mitigation and Monitoring Plan shall include the following details: <br /> r <br /> The location(s) of mitigation areas,including the types and extent of each habitat type to be <br /> F created. <br /> F4 • Mitigation for loss of existing wetlands shall be provided by the creation of 4 acres(3:1 <br /> mitigation ratio) of wetlands meeting the current federal definition, and 9 acres of riparian <br /> plantings (2:1 mitigation ratio). <br /> i • All graded or filled areas within the habitat restoration area shall be seeded with <br /> appropriate mixes of native b qualified restoration <br /> grass and forb species, developed g P P Y a <br /> ecologist. <br /> • Restored wetlands and riparian habitat shall have an equal or higher habitat value; <br /> • A water budget shall be prepared analyzing water demand for each mitigation habitat type <br /> and the ability of the watershed to support the target habitats. <br /> • The stated goal of the mitigation effort shall be to establish self-sustaining native riparian <br /> vegetation that shall not require long-term irrigation or maintenance. <br /> F. • The mitigation site shall include the establishment of a vegetated upland buffer no less than <br /> 50 feet wide on all sides,where practicable. <br />
